Mediation Services

Mediation is a process by which disputing parties can work together with a neutral mediator to try to reach a satisfactory conclusion fashioned by both parties and completely within their control.  Many family law litigants find this process superior to letting a judicial officer decide the solutions for their family. No judicial officer, regardless of their experience and skill level, can ever know and understand your family, your needs, your children, and your situation as thoroughly as you do. This is why mediation is desired and used by so many involved in family disputes.

At this time, with courts shuttered and judicial solutions unavailable, mediation is more necessary than ever.

More about the mediation process:

Unlike an arbitrator, the mediator has no power to resolve the dispute, but instead acts as a facilitator for the disputing parties. Mediation is ordinarily voluntary and is generally a more informal and flexible process than arbitration. See California Code of Civil Procedure §1775.1Evidence Code §1115Cal Rules of Court 3.800(2).

It is widely recognized that parties can benefit from the availability of alternative dispute resolution processes for resolving disputes in a “fair, timely, appropriate, and cost-effective manner” through “less formal processes than adversarial adjudication.” California Code of Civil Procedure §1775(a). See also Rojas v Superior Court (2004) 33 C4th 407, 415; Cal Rules of Ct 3.800(1). This is especially true in child custody and visitation disputes, in which parents will need to continue to work cooperatively after their relationships have ended. In custody cases, the legislature and courts have recognized a “strong preference towards mediated, private resolutions.” Marriage of Dunn-Kato & Dunn (2002) 103 CA4th 345, 348. In addition, the Family Code requires court-ordered mediation in all cases in which contested custody or visitation issues are presented. Fam Code §3170.​

Ventura County Child Custody Recommending Counseling:

In the Ventura County Family Court system, the court requires parties to a custody dispute to mediate with a trained court counselor mediator who will make a recommendation to the Judge.
